All refunds and returned deposits will be given solely at the Host’s discretion and will be less a 5% processing fee and any commissions and/or fees the Host has paid. Below are the House Rules for this home. Upon booking this home, you will be required to sign a contract that states all of the below rules and liability waivers. Notwithstanding the terms of any other agreements entered into between the Guest booking the short-term rental ("Guest") and Superprestige H.A.M., LLC DBA Super Stays or Superprestige A.S.A.P., LLC, to be determined by billing statements ("Host"), or any agreements entered into by and between Guest, Host this letter will confirm our Agreement as it relates to Guest's stay. The parties agree that the Guest may occupy the Property from the confirmed reservation dates in the reservation confirmation email sent to the Guest ("Check-In Time") to ("Check-Out Time"). Standard Check-in is between 4:00 pm and 6:00 pm on the Check-In Date. Standard check-out is at 11:00 am on the Check-Out Date unless the Host has given written consent; additional fees may apply. Guest recognizes and agrees that they are guests at the Property and are not entitled to any tenancy rights under any federal, state, or local laws, including the Uniform Residential Landlord Tenant Act. In the event the Guest shall fail to vacate the Premises as of the Check Out Time, then the Guest shall be subject to a fee of five hundred and fifty dollars an hour. The maximum capacity of the Property is determined by the guests' registered number of total Guests prior to Check-In Date. If the Guest allows the maximum number of individuals on the Property to be exceeded, then the Guest shall be subject to a fine of two hundred fifty dollars per day of the Booking for each additional individual on the Property. The Guest agrees to follow all house rules; any violation of rules may result in the Guest's stay being terminated immediately with no refund. Guest agrees that they shall leave the Property in as good of condition or better than when they check-in, damage from casualty excepted. In the event a Guest damages the Property, then they shall, immediately after receiving written demand from Host, reimburse Host for its costs for making such repairs and/or replacements. If Property Damage has occurred, the Host has the right to draw against the payment card up for compensation of damage that is payable to the Host. The Host will determine if repairs or replacement of damage is the best course of action. Unless Host is notified of any damage to the Property, including the appliances located therein, within two hours of the Check-In Time, then any damage as of Check-Out Time shall be assumed to have been caused by the Guest, and the burden of proving otherwise shall lie with the Guest. The Property is a non-smoking Property. If smoking on the Property occurs, the Guest shall be subject to a fine of two thousand five hundred dollars. The Property is a non-party Property. If partying on the Property occurs, the Guest shall be subject to a fine of two thousand five hundred dollars. Furthermore, pets are only allowed on the Property with written approval from the Host, and a non-refundable pet deposit fee will be assessed. There is a two hundred and fifty-dollar fee for unauthorized pets plus a fee for any additional cleaning required in the unit. Parking for the Property is located in the parking lot next to the Property; Host shall not be liable to Guest for theft or damage caused while Guest's car is parked on or off the Property. Guest agrees that its use of the Property shall at all times comply with all applicable laws, rules, and regulations of any applicable governing authority. The Guest agrees not to use the Property for any commercial purposes, including photography, film, subletting, and any other commercial purposes. There is a ten thousand dollar fee for unauthorized commercial use of this Property without prior written approval from the Host. Guest will pay and discharge and indemnify and save harmless Host against and from all actions, causes of action, liabilities, obligations, damages, penalties, demands, claims of any nature whatsoever, liens, costs, charges, and expenses, including reasonable attorneys' fees which may be imposed upon or incurred by or asserted against Host and/or against the Property by reason of Guest's use of and/or occupancy of the Property. All stays are non-refundable. All refunds and returned deposits will be given solely at the Host’s discretion and will be less a 5% processing fee and any commissions and/or fees the Host has paid. The guest will not, under any circumstances, issue or threaten to issue any chargebacks to the Company or to the Client’s credit card and/or form of payment (ie, Stripe, PayPal) for any reason whatsoever. In the event of a chargeback, the Host reserves its right to report it to the credit bureaus as a delinquent account. Upon not less than twelve (12) hours' notice to Guest, Host and/or Host's agents shall have the right to enter upon the Property, or any part thereof, at any and all reasonable times for the purpose of examining the same or making repairs and maintenance. 1. GUEST CONSENT 1.1 To protect the Host's interest in the Property, the Guest agrees to complete a Booking Validation. This may mean the Guest is required to verify their identity (I.D.) in advance of the Booking, and if asked, the Guest agrees to submit a photographic I.D. 1.2 The Host may pass the Guest's details to a third-party provider to carry out I.D. verification and other checks. 2. PROPERTY DAMAGE 2.1 The Guest acknowledges that they are liable to pay for all Property Damage to, at, or in the Property during their Booking which was directly or indirectly caused by their own action or inaction. 2.2 If the Guest does not report Property Damage to the Host, which can be demonstrated to have been caused before the agreed upon check-in time, then it will be assumed that the Property Damage was caused by the Guest and the Guest accepts liability for the damage. 2.3 The Guest agrees to compensate the Host for any fees or charges the Host might have to pay, including compensation to occupiers of neighboring premises caused by the Guest's actions or failure to fulfill any of the obligations in this Agreement. 3. SECURITY DEPOSIT 3.1 Where the payment of a Security Deposit by the Guest is required for a Booking, the Guest agrees to provide details of a payment card which will remain valid until at least 30 days after the Booking has been completed. 4. PROPERTY USE 4.1 The Property may only be used for purposes permitted by the Host. 4.2 Any appliance, fixtures and fittings must be operated in accordance with provided instructions and in a reasonable and careful manner. 4.3 There is a strict policy against Parties in or at the Property, unless pre-approved by the Host in writing. 5. GUEST OBLIGATIONS AND ACKNOWLEDGEMENTS 5.1 The Guest acknowledges that they are liable for all costs associated with damage to, at or in the Property during their Booking which was directly or indirectly caused by their own action or inaction. 5.2 The Guest always agrees to use the Property only as permitted by the Host and always in a reasonable and responsible manner. 5.3 The Guest takes full responsibility for the behavior of any person they have permitted to enter the Property. 5.4 The Guest agrees to act as soon as they become aware of any Property Damage or problem to minimize its effects and prevent it becoming worse or causing a nuisance to the occupier of any neighboring premises. 5.5 Wherever possible, the Guest will take a photographic record of the Property at the start and the end of the Booking and upload to the message thread with the host. If the Guest chooses not to do this the Guest acknowledges that it will be hard for them to prove that they did not cause the damage. 5.6 The Guest will take steps to ensure the security of the Property. Not limited to, keeping doors locked at all times. 5.7 The Guest will take care to avoid blocking or causing damage to drains or sanitary appliances. 5.8 The Guest will keep the Property appropriately and safely ventilated to ensure that there is no build-up of dampness or moisture or of cooking smells, smoke, or grease. 5.9 All obligations on the Guest in respect of the Property apply equally in relation to any building of which the Property forms part and in relation to any access, parking, or right of way associated with the Property. 5.10 The Guest acknowledges that the cost of Property Damage will be determined at The Host’s sole discretion. 5.11 House Rules Include Please review our house rules and let us know how we can help ensure a 5-star experience! 1. AGREEMENT 6.1 To the extent this Agreement is signed by an agent or representative of a Guest, it is deemed to also bind the Guest, and that the Guest has expressly agreed to the terms in this Agreement. 7. GENERAL 7.1 Any notices required under this Agreement will be deemed if sent by email to the Guest, provided that no such notification of non-delivery is received, and the notice will be deemed served eight hours after sending of the email. 7.2 The unenforceability or invalidity of any clause in this Agreement shall not have an impact on the enforceability or validity of any other clause. 7.3 This Agreement is governed by and construed in accordance with the laws of England and Wales. The Host and Guest agree to submit to the exclusive jurisdiction of the English courts This letter may be executed by electronic signature and in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument. Counterparts may be delivered via electronic mail (including pdf or any electronic signature complying with the U.S. federal E.S.I.G.N. Act of 2000, e.g., www.docusign.com) or other transmission method, and any counterpart so delivered shall be deemed to have been duly and validly delivered and be valid and effective for all purposes. Except as modified by this letter, Host and Guest agree that their relationship shall be governed by the applicable agreements entered into with the Hosting Platform.
