Guest Accommodation Terms and Conditions of the accommodation provider § 1 Conclusion of the guest accommodation contract
1. the accommodation provider offers the guest the conclusion of an accommodation contract. After acceptance of the offer by the guest and with the sending of the booking confirmation, the accommodation contract is concluded.
2. in the interest of the contracting parties, the booking shall be made in writing.
3. the booking is also made by the booking guest for all persons listed in the booking, for
whose contractual obligations the booking guest is responsible for as for his own obligations.
§ 2 Services, prices and payment
1. the services owed by the accommodation provider result exclusively from the booking offer in conjunction with the information in the catalog / Internet.
2. the prices quoted are final prices and include all additional costs.
3. the agreed price, including all ancillary costs, is due on the day of arrival, unless otherwise contractually agreed.

§ 3 Cancellation
1. the conclusion of the guest accommodation contract obliges both contracting parties to fulfill the contract, regardless of the duration of the contract. A unilateral, cost-free withdrawal on the part of the guest from a binding booking is generally excluded.
2. if the guest nevertheless withdraws from the contract, he is obliged to pay the agreed or customary price, irrespective of the time and reason for the withdrawal.
However, the owner of the accommodation establishment must allow any expenses saved to be offset against the claim for fulfillment. According to case law, the value of the expenses saved when renting out a vacation apartment or vacation home is recognized as reasonable at a flat rate of 10% to 20% of the accommodation price.
3. instead of fulfillment, the owner of the accommodation establishment may demand a flat-rate cancellation fee in the following amount (each in % of the agreed accommodation price):
Cancellation up to the 31st day before the start of the rental period - free of charge
Cancellation up to the 21st day before the start of the rental period - 20% (but at least 25 euros)
Cancellation up to the 5th day before the start of the rental period thereafter

4. the proprietor of an accommodation establishment must in good faith rent out any accommodation not used to another party and must allow the savings thereby made to be offset against the cancellation fee claimed by him.
5. the guest reserves the right to prove that the accommodation provider has incurred no or significantly less damage.
6. the declaration of withdrawal must be addressed to the accommodation provider and should be made in writing in the interest of the guest.
7. the conclusion of a travel cancellation insurance is strongly recommended.
§ 4 Defects in the accommodation service
The accommodation provider is liable for the proper provision of the contractually agreed service. If the rented accommodation has a defect that goes beyond a mere inconvenience, the guest must notify the owner of the accommodation establishment or his representative of the defect immediately in order to enable the accommodation establishment to remedy the defect. If the guest fails to do so, he shall not be entitled to any claims.
